Collection Notification Statement

Please read this carefully as it will have important consequences for you in relation to the collection, use and disclosure of your personal information you provide to EPI Capital Pty Ltd (ACN 158 472 943), Tanda Software Pty Ltd (ACN 688 399 724) and our Related Entities and Related Bodies Corporate (as defined under the Corporations Act 2001 (Cth)) (collectively, Tanda, we, or our) via the Tanda application (Tanda App).
You understand that:
- Tanda will collect your personal information:
- directly from you via your use of the Tanda App; and
- from the Tanda customer who is employing or contracting you (Tanda Employer), including but not limited to, your name, email, phone number, date of birth, pay rate or award classification, training / qualification information.
- Tanda will also collect certain information either from you directly or via your Tanda Employer via encrypted fields, namely your bank account number, residential address, superannuation Fund Membership number and fund name and your tax file number (Encrypted Personal Information).
- We will use your personal information (other than Encrypted Personal Information) for the following purposes:
- the provision of our services to you via the Tanda App, including creating an account for you and providing support to you and the Tanda Employer in relation to your use of the Tanda App;
- to manage, maintain, develop, improve and enhance the Tanda App and for other development, research, data analytics, diagnostic and corrective purposes in connection with the Tanda App and other Tanda offerings;
- for general administrative and security purposes such as ensuring our website and applications remain secure; maintaining and developing our products and for quality assurance purposes;
- to monitor your use of the Tanda App to ensure you are using the Tanda App in the manner in which it is intended to be used, and in accordance with the applicable Terms of Use;
- to aggregate with other information and then to use it for marketing and consumer analytics;
- in respect of location information, to facilitate your Tanda Employer's use of specific functionalities for employee management within the Tanda App (if activated by your Tanda Employer). For example, your Tanda Employer may configure the Tanda App such that you may only clock in upon verifying that you are within business premises;
- in respect of information you provide through your, or your Tanda Employer's use of the Tanda HR Software, to enable and facilitate your participation in our customer programs (such as loyalty and benefits programs);
- to offer you updates on products, events or information that may be of interest to you; and
- for marketing and promotional activities by us (including by direct mail, telemarketing and email) such as our email alerts, product awareness information and newsletters.
- We will use the Encrypted Personal Information to verify your identity and (if directed by you) to create a new superannuation account on your behalf. We will otherwise use the Encrypted Personal Information as directed and controlled by the Tanda Employer for them to manage their relationship with you, including paying you and fulfilling various obligations such as taxes, superannuation and statutory reporting.
- If we do not collect your personal information for the above purposes, Tanda will be unable to provide you with our services via the Tanda App and the Tanda Employer you may not be able to appropriately pay or roster you.
- We may disclose your personal information to:
- the Tanda Employer for the purpose of managing your employment or contracting relationship with them, or otherwise accordance with the Tanda Employer’s privacy policy;
- your superannuation fund or other financial service providers to whom the Tanda Employer makes contributions on your behalf;
- our third-party providers or contractors for them to who assist Tanda in providing our programs, products and services;
- related bodies corporate of Tanda (including related entities);
- third parties in connection with any business sale; and
- as required or authorised by any law.
- It is possible that some of your personal information may be disclosed to parties outside of Australia or New Zealand (as applicable).
- If you are an Australian resident: You consent to your information being disclosed to a destination outside Australia and you understand and acknowledge that Australian Privacy Principle 8.1 will not apply to such disclosures of your personal information.
- If you are a New Zealand resident: You consent to your information being disclosed to a destination outside New Zealand and you understand and acknowledge that the recipient may not be required to protect your personal information in way that provides comparable safeguards to those in New Zealand's privacy law.
- Tanda’s Privacy Policy sets out the process as to how you can access and correct any of your personal information collected under this form as well as to how you can make a complaint if Tanda has breached the Privacy Act in the handling of your personal information. Tanda’s Privacy Policy is available at https://www.tanda.com.au/privacy/ or can be otherwise provided by requesting a copy from Tanda.
By continuing to access or use the Tanda App you indicate that you have read this collection notification and acknowledge that your personal information will be collected, used and disclosed in accordance with this collection notice and as otherwise detailed in Tanda’s Privacy Policy and, to the extent it is necessary, that you give your voluntary express consent to Tanda collecting, using, storing, disclosing and disposing of your personal information in this manner.
